OFFICIAL RULES
 
NO PURCHASE NECESSARY
 
1.    HERE’S HOW IT WORKS: Beginning 8:00 AM ET on 2/1/10 and ending 11:59:59 PM ET on 4/12/10. Qualified restaurant owners may visit www.Dawncelebrations.com and complete an application in the Dawn Make Your Restaurant Shine Contest (the “ Contest”). Applicants will be required to answer 4 questions as part of the application. The online questions are located at the Program website and should be answered in essay format and will be judged based on the criteria listed in Rule #4. The top scoring application will be deemed the winner and will receive a $20,000 award for restaurant and/or kitchen renovations/improvements for the restaurant location indicated on the winning entry. In addition, the winner will receive a restaurant consultation by chef/restaurateur Spike Mendelsohn and a trip for four to the 2010 National Restaurant Association Conference in Chicago from May 22-25, 2010 where the  winner will be presented with the  Award. The owner of the winning restaurant indicated on the entry will be deemed the winner; the $20,000 check will be awarded to the Restaurant indicated on the winning entry. 2.    ELIGIBILITY: This promotion is open only to residents of the 50 United States (except Maine) or the District of Columbia who are 18 years of age or older at time of entry (except residents of AL & NE who must be 19 years or older at time of entry and residents of MS who must be 21 years of age or older at time of entry) and are the legal owner of a restaurant. To be eligible, restaurant must be located in the 50 United States or the District of Columbia. Employees of Procter & Gamble, its affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state and local laws and regulations apply. Void in Maine and where prohibited by law.
 
3.    HERE’S HOW TO ENTER: Beginning8:00 AM ET on 2/1/10, visit www.Dawncelebrations.com and follow the on-screen instructions to complete the 4 question application and the Official Entry Form. Submissions must be in English. Participants may not submit an entry for another person. 
 
Essay Submission: Writean original essay in response to each of four questions on the application in an essay using 100 words or less.  Follow the onscreen instructions to submit your essays. Each question must be answered to be considered a complete entry.
 
ALL ENTRIES MUST BE YOUR OWN ORIGINAL UNPUBLISHED WORK AND CANNOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION.

Submission must be your original work that has not been previously published nor won a prize or award. Modifying, enhancing or altering a third party’s preexisting work does not qualify as Entrant’s original creation. Sponsor/judges reserve the right in their sole discretion to disqualify any entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Contest or any other person or entity, or does not comply with  the Official Rules.  Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Sponsor. 

Entries must be received by 11:59:59 PM ET on 4/12/10
Limit one entry per restaurant address. All material submitted becomes property of Sponsor and will not be returned. No correspondence will be acknowledged or entered into.
 
4.    JUDGING: All eligible entries received will be preliminarily judged by the Sponsor to determine the top 15 entries. The top 15 entries will then be judged by a panel including Sponsor representatives and Spike Mendelsohn to determine the Grand Prize Winner. All judging will be based on the following criteria: Originality & Creativity of Submission – 50%; Appropriateness of Submission to Subject Matter – 35% and Sincerity of Submission – 15%. In the event of a tie, tied entries will be broken based on the highest score for “Originality & Creativity of Submission”. Sponsor reserves the right to substitute another judge in the event Spike Mendelsohn is unavailable. Winner will be notified by mail/express delivery carrier.
 
5.    PRIZE: (1) Grand Prize Winner will receive a prize consisting of the following:
 
1) an award of $20,000 (awarded to the restaurant in the form of a check) for restaurant and/or kitchen renovations/improvements to the restaurant location indicated on the entry form; and
 
2) a restaurant consultation by chef/restaurateur Spike Mendelsohn; The consultation will take place at the restaurant location indicated on the entry form; consultation is subject to scheduling and availability; there is no monetary value associated with consultation portion of the prize; and
 
3) a trip for four to the 2010 National Restaurant Association Conference in Chicago, May 22-25, 2010 where winner will be presented with the $20,000 award. The trip includes round-trip coach air transportation from major airport nearest winner’s home, 3 nights hotel accommodations (2 rooms/double occupancy) admission to the conference, winner and adult guests will travel together. Winner is solely responsible for all other expenses not specifically set forth herein, including but not limited to meals, additional transportation, souvenirs, upgraded room accommodations and other incidentals and items of a personal nature. The actual retail value of the trip portion of the prize will depend on winner's point of departure/return. In the event the 2010 National Restaurant Association Conference is cancelled or postponed for any reason, Sponsor will have no obligation to award compensation in lieu thereof, and prize check to be distributed as mutually agreed by both parties. Prize consists of only those items specifically listed as part of the prize.
 
Total Approximate Retail Value: $28,000. Winner may be asked to provide documented proof of restaurant and/or kitchen renovations/improvements to the restaurant location indicated on the entry form.
 
  1. GENERAL RULES: Potential winner will be required to complete an Affidavit of Eligibility certifying that the submission is his/her own original work and he/she holds all rights to the submission, that the submission has not been previously published, has not won a previous prize or award, that he/she followed the Official Rules of the Contest and that he/she agrees to provide proof of restaurant ownership listed on Official Entry Form.  Additionally, potential winner will be required to complete a Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release. All documents must be completed and returned within 5 business days of attempted delivery of same.  Noncompliance within this time period or return of any prize/prize notification as undeliverable will result in disqualification without further notice and an alternate winner will be selected. This process will continue until actual winner is determined. Guests must be adults according to the laws of their state. Winner must possess required travel documents (e.g., valid photo ID) prior to departure; must agree to depart and return on dates specified by the Sponsor; dates of departure and return are subject to change. No substitution or transfer of prize by winner permitted. Sponsor reserves the right to substitute prize of equal or greater value, or a cash substitute for Grand Prize, or any portion of the Grand Prize, at its sole discretion. All applicable taxes are the sole responsibility of winner/business. In no event will more than the stated number of prizes be awarded. All material submitted becomes the sole property of Sponsor and none will be returned. If an entrant submits more than the stated number of entries permitted, and/or if the Sponsor suspects that an entrant attempted to obtain additional entries by using multiple email addresses, registrations, identities or any other method, all entries submitted by the entrant will be declared null and void. Sponsor/judgesreserve the right to: (a) use contestant’s name and likeness and reproduce/distribute all entries submitted in any and all media throughout the world in perpetuity, (b) alter, amend, edit or change entries prior to distribution and (c) use, distribute, reproduce, alter, amend and copyright entries for purposes of advertising and trade compensation, unless prohibited without further by law.   By accepting prize, winner agrees to hold Sponsor, its respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner's name and/or likeness, restaurant name and/or entry submissionfor purposes of advertising and trade without further compensation, including a winners’ list, unless prohibited by law. Entrants agree to release, discharge and hold harmless Sponsor, its respective directors, officers, employees and assigns, harmless from and against any and all liability and damages. By participating in this promotion, entrants agree to be bound by the Official Rules and the judges’ decisions which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any sweepstakes materials and the terms and conditions of theOfficial Rules, the Official Rules shall prevail, govern and control. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the award. 

    NOTICE TO ONLINE ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Not responsible for faulty, incorrect or mistranscribed  electronic transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion.  Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion. In the event of termination, a notice will be posted online and all eligible entries received prior to termination will be included in the judging. Any damage made to the Web Site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries will not be deemed to be proof of receipt by Sponsor. Any entries which are suspected of being fraudulent (including those using robotic, automatic, programmed or similar methods of participation) will be disqualified, based on determinations made solely by Sponsor. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
